Baby Killer Loses Appeal To Overturn Death Penalty

Rigoberto Avila was convicted of killing 19 month old Nicolas Macias. The baby was one of two children he was baby sitting the night of Feb.29, 2000. He called 911 and reported that the baby's 4 year old brother had covered the baby's mouth while they were playing.

The evidence showed that the baby had been kicked in the stomach with enough force to rip the organs of the baby from his spine. This force is equal to someone jumping from a car going 60 mph.

Avila said he stomped on the baby because he was jealous of the attention he was receiving from the baby's mother.

This man should have received the death penalty, and I am so glad it was not overturned! Anyone who does harm to a child, in my eyes deserves the death penalty.
